An accident at work is a sudden incident resulting in injury, or death caused by external factors due to work.

An event can be considered an accident at work if all four conditions are met simultaneously, i.e. a sudden incident caused by an external factor causing injury due to work.

The first element of the definition speaks of the suddenness of the event, which does not raise any doubts in the case of dynamic injuries resulting from falls, impacts, cuts, etc.

It may be ambiguous to assess an event when the human body is affected by harmful working conditions, climatic conditions, chemical or biological substances, the effect of which is felt after a certain time of operation.

In such cases, according to the Social Insurance Tribunal and the Supreme Court ruling, an accident is considered an event caused not only by a single impact of an external factor but also by a period not exceeding one working day.

An accident on the way to work or from work is a sudden incident caused by an external factor, which occurred on the way to or from work if this route was the shortest or the most convenient regarding the connection and was not interrupted unless important life reasons justified this interruption.

An employee who has an accident is obliged to immediately report this fact to his/her supervisor.

If you are a witness or participant of an accident at work or on the way to work, or you have noticed a real danger to life or health in your workplace, you must immediately report this fact to your supervisor, who is obliged to take action necessary to eliminate or reduce the life-threatening situation and provide first aid to people injured, after securing the place of accident, providing assistance, calling for medical assistance, the employee's superior reports the accident to the Health and Safety Inspectorate of the Jagiellonian University.
